SALE ANNOUNCEMENTS: Announcements the day of the sale take precedence over all printed matter and advertising.
TERMS: All purchases must be settled for on Sale Day unless other arrangements have been made. Full settlement may be by Cash, Cashier’s Check or Company and Personal Checks. Checks must have a Bank Letter of Credit SPECIFYING THE AMOUNT OF PURCHASES GUARANTEED BY THE BANK. SALES TAX: All Sales will be subject to State and Local Sales Tax Laws.
BIDDING: In case of a tie bid, auctioneer reserves the right to reopen the bid between those two bidders. Auctioneer reserves the right to revoke any bid card at any time. Anyone bidding for an account other than their own must obtain a separate bid number for that account.
BUYERS PREMIUM: 10% per item will be charged to all purchases made and Internet bidders will have an additional 3% fee added to each item purchased.
NO WARRANTIES: All sales are AS-IS, WHERE-IS, and with all faults. Bidder should inspect all sale items and bidder agrees to solely rely on his inspection. All sales are final. Bidder understands and agrees there will not be any changes, adjustments, allowances, or damages or any other remedy regarding the condition of any item bid on and purchased.
AUCTION SITE: ALL BIDDERS OR INDIVIDUALS AT THE AUCTION SITE ARE THERE AT THEIR OWN RISK. Bidder agrees the auction site can be dangerous due to the use of heavy loading equipment and the operation of same. Bidder agrees the Auctioneer or its agents will not be responsible for any injury to anyone at the auction site.
RISK OF LOSS: Once auctioneer accepts the highest bid, each item is then sold. Buyer accepts, then takes delivery, assumes all risk of loss for the item and buyer agrees to obtain full liability of loss and should obtain insurance coverage for the item.
TITLES: Titles are not available on sale day and will be mailed to purchaser approximately 10 business days after satisfactory settlement. No titles will be available if vehicles are marked “No Title”. BOS marked on items means bill of sale ONLY.
LOADING & REMOVAL: All equipment must be removed by the allotted time but normally within two days after the sale unless other arrangements have been made. Bobby Lewis Auction & Real Estate, Inc. or employees/staff are not responsible for loading or unloading equipment but will assist you with your equipment when loaders are available. Buyer is responsible for securing lad and Auction Company personnel are not responsible for securing loads.
